This Privacy Notice (“Notice”) describes the information collection, use, retention and sharing practices of Artificial Intelligence in Medicine, LLC d/b/a DOCipher (“DOCipher”, “we”, “our”, or “us”) when you interact with us through our website, [●] (the “Website”), our mobile applications, and/or online or mobile-enabled technology and/or digital tools that display or link to this Notice (collectively, the “Platforms”), and when you otherwise interact with us (the “Services”).
PERSONAL INFORMATION WE COLLECT, WHY AND FOR HOW LONG
We collect personal information, which is information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, to you. We collect personal information from a variety of sources in a variety of ways, including when you:

Contact us. When you contact us through the Services, we collect, from you, your personal identifiers (name, email address, telephone number) and any information you choose to include in your message. We use this personal information to respond to your questions or inquiries, troubleshoot where necessary, and address any issues you have with the Services. Create a User account. When you create a user account (“User Account”), we collect, from you, your personal identifiers (name, email address, telephone number,). Although not collected by DOCipher, our third-party payment processor will also collect your sensitive financial information (payment card number, CVV, and expiration date, billing address). We use this information to create and manage your User Account, authenticate you for subsequent logins, and to communicate with you about your User Submissions (information you submit to the Services) by email, and add you to our e-mail marketing list. Please note that we will continue to send you email notifications necessary to the services or requested products or services. If you wish to opt-out of email message communication email info@docipher.com. If you wish to opt-out of emails click the “unsubscribe” button, and for opting out of text message communication reply “STOP” to any text message or email info@docipher.com. Your sensitive medical information will be shared as part of your user submission with the person assigned to review your submission and provide information and education related to your submission.

Create Reviewer account. When you set up an account to be a user submission reviewer (“Reviewer Account”), we will collect your identifiers (name, email address, telephone number, NPI number), sensitive personal information (Tax identification number), education information, employment information (employer name), your visual information (profile photograph). We use this information to create and manage your Reviewer Account, authenticate you for subsequent logins, and to communicate with you about your reviews, payments, and User communications by email and text message. Please note that we will continue to send you email notifications necessary to the services or requested products or services. Interact with the Services. In addition to the personal information you provide directly to us, we also collect information from you automatically as you use our Services via cookies, SDKs, and similar tracking technologies. This includes the following internet or other electronic network activity information.

We use essential, performance, and analytics cookies to collect your usage, device, and approximate location information when you interact with the Services. We use this information to: (i) track you within the Services; (ii) enhance user experience; (iii) conduct analytics to improve the Services; (iv) prevent fraudulent use of the Services; and (v) diagnose and repair Services errors, and, in cases of abuse, track and mitigate the abuse.

Aggregate data. We aggregate the data we collect for benchmarking purposes and for internal analytics and to improve the Services, including train our Artificial Intelligence.

Automated decision-making. We perform automated decision-making and train our algorithms using your personal information, including the information you explicitly provide through the Platform and Website (account information, your submission of information, website browsing history (e.g., what webpages in our platform you visit, how often, etc.), how you use the Platform (what services you use), and from where you are accessing the Services to improve our Services. To object to the automated decision-making related to your personal information, you may contact us at info@docipher.com.
DOCipher will also use the personal information we collect as described in this section to comply with the law, to efficiently maintain our business, and for other limited circumstances as described in HOW WE SHARE YOUR PERSONAL INFORMATION.
DATA RETENTION
We use the following criteria to determine whether it remains reasonably necessary to retain your personal information for one or more disclosed operational purpose, or a service provider or contractor’s operational purpose(s): (i) whether there is a retention period required by statute or regulations; (ii) the existence of actual or threatened litigation for which we are required to preserve the information; (iii) the statutes of limitations for potential legal claims; and (iv) generally accepted best practices in our industry, including related to safety and security of our properties and assets. When we determine that it is no longer reasonably necessary to retain your personal information for one or more disclosed operational purposes based on the above criteria, we will delete your personal information.

General Sharing
DOCipher shares personal information in the following instances:

Within DOCipher. We share your personal information within DOCipher for the legitimate business purposes of efficiently and effectively providing the Services, such as accounting and customer service support. Access to your personal information is limited to those on a need-to-know basis.

In the event of a corporate reorganization. In the event that we enter into, or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our business, assets or stock, we would share personal information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. We will also share personal information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings.

DO NOT TRACK
We do not respond to Do Not Track requests. Do Not Track is a preference you can set in your web browser to inform websites and mobile applications that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.
CALIFORNIA SHINE THE LIGHT ACT
If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by DOCipher to third parties for the third parties’ direct marketing purposes. Pursuant to California Civil Code Section 1798.83(c)(2), DOCipher do not share your personal information with others outside of DOCipher for those parties’ direct marketing use unless a you elect that we do so.

Removal of Content
If you are a California resident under the age of 18, and a registered user of any site where this policy is posted, California Business and Professions Code Section 22581 permits you to request and obtain removal of content or information you have publicly posted.

Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted and that there may be circumstances in which the law does not require or allow removal even if requested.
NOTICE FOR NEVADA RESIDENTS
Certain Nevada consumers may opt out of the sale of “personally identifiable information” for monetary consideration (as defined under Nevada law) to a person who in turn licenses or sells such information to another person. We don’t currently sell or provide your personal information in this manner. However, to opt out of the sale of your personal information in the future, you may submit a request to us via email to info@docipher.com. Proof of identification may be required before such a request is granted.
INFORMATION SECURITY
We implement appropriate technical and organizational security measures, such as access controls and encryption (at rest and in transit), to protect the personal information that we collect and maintain from unauthorized access, destruction, use, modification, or disclosure. However, no security measure or modality of data transmission is 100% secure, and we are unable to guarantee the absolute security of the personal information we have collected from you.
CHILDREN’S PRIVACY
The Services are not intended for individuals under the age of eighteen (18) years. If we learn that we have collected or received personal information from individuals under the age of eighteen (18), we will delete the personal information. If you believe we have personal information on individuals under the age of eighteen (18), please contact us at the contact information provided below.
CHANGES TO THIS PRIVACY NOTICE
We may amend this Privacy Notice in our sole discretion at any time. If we do, we will post the changes to this page, and will indicate the date the changes go into effect.
